Music without licence: FIR against hotel, auto giant

Novex Communications Pvt Ltd, a copyright assignor of Zee Music, has lodged an FIR against the hotel management and the company, which had organized a function in the hotel's banquet hall on July 24 evening.

The musical piece which stirred trouble was Marathi film Sairat's number 'Zingat', for which Novex holds the copyright and the authority to grant permission to play it live in public. Novex's office-bearer in the city, Keval Dholeria, has registered the FIR and the hotels - Hyatt as well as Junior Hotels Pvt Ltd - the automobile company, the disk jockey, and the event manager have been booked under sections 38 and 418 of the IPC and sections 63 and 69 of the Indian Copyright Act, 1957.

These offences have provisions of jail term ranging from six months to three years. Vadaj police has sent a copy of the FIR to the metropolitan court No. 9 and initiated further proceedings. In December last, Novex had obtained an injunction from the city civil court to restrain city hotels from playing its copyrighted music without obtaining licence. When certain hotels did not follow the diktat, the music company filed a contempt of court petition, which is pending in court, said company's counsel Samrat Mehta. The lawyer said that most of the hotels, resorts and discotheques obtain licence by paying annual fees, but they are also required to obtain separate licence for special occasions.
